Terms and Conditions

1. Introduction

 

Welcome to Comppers Pty Ltd's website. These Terms and Conditions govern your access to and use of our website and services as an NDIS service provider. By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions.

 

2. Definitions

 

In these Terms and Conditions:

- "We", "us", "our" and "Provider" refer to Comppers Pty Ltd

- "You", "your" and "Participant" refer to the person accessing our website or services

- "Services" refers to the NDIS supports and services we offer

- "NDIA" refers to the National Disability Insurance Agency

- "NDIS" refers to the National Disability Insurance Scheme

- "Website" refers to www.compperscare.com.au

- "Service Agreement" refers to the separate agreement between the Provider and Participant detailing specific services

 

3. Acceptance of Terms

 

By accessing our website or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, please do not use our website or services.

 

If you are accepting these terms on behalf of a Participant as their authorized representative, you confirm that you have legal authority to do so.

 

4. Service Description

 

4.1 NDIS Services

 

We provide disability support services in accordance with the NDIS framework. Our specific services include:

 

Core Support Services

  • Household Support

  • Daily Personal Care

  • Community Nursing

  • Shared Living Assistance

  • Travel and Transport Assistance

  • High Intensity Personal Care

 

Capacity Building Support

  • Community Participation

  • Employment and Education

  • Life Transitions Support

  • Daily Skills Development

  • Community Activities

  • Group and Centre-based Activities

 

Support Coordination

 

4.2 NDIS Compliance

 

We are a registered NDIS provider (Registration Number: 4-433C-4227) and comply with the NDIS Practice Standards, NDIS Code of Conduct, and all other relevant NDIS Quality and Safeguarding Framework requirements.

 

4.3 Service Delivery

 

All services are delivered in accordance with:

  • The Participant's NDIS plan

  • A signed Service Agreement

  • Relevant NDIS pricing arrangements and price limits

  • Australian law and professional standards

 

5. Service Agreements

 

5.1 Requirement for Service Agreement

 

Prior to service delivery, we require a signed Service Agreement that details:

  • Services to be provided

  • Service schedules and duration

  • Costs and payment arrangements

  • Participant and Provider responsibilities

  • Cancellation and termination conditions

 

5.2 Relationship to These Terms

 

The Service Agreement forms a separate, binding contract between the Provider and Participant. In case of conflict between these Terms and Conditions and the Service Agreement, the Service Agreement prevails to the extent of the inconsistency.

 

6. Bookings and Cancellations

 

6.1 Booking Services

 

Service bookings can be made through our website, by phone, email, or in person, subject to availability and NDIS plan approval.

 

6.2 Cancellations

 

Cancellation fees apply in accordance with the NDIS Pricing Arrangements and Price Limits, which may include:

  • No fee for cancellations with reasonable notice (as defined in the Service Agreement)

  • Partial or full service fee for short-notice cancellations

  • Full service fee for no-shows

 

6.3 Provider Cancellations

 

If we need to cancel a service, we will:

  • Provide as much notice as possible

  • Reschedule the service at a mutually convenient time

  • Not charge for the cancelled service

 

7. Payments and Billing

 

7.1 Service Fees

 

Our fees align with the current NDIS Pricing Arrangements and Price Limits. Specific fees for services will be detailed in your Service Agreement.

 

7.2 Payment Methods

 

We accept payments through:

  • NDIS portal claiming (NDIA-managed funding)

  • Plan Manager invoicing

  • Direct payment (for self-managed participants)

  • Payment from other third-party companies

 

7.3 Invoicing

 

Invoices will be issued in accordance with your funding management type and will include details of services provided, dates, and applicable charges.

 

7.4 Overdue Payments

 

We reserve the right to:

  • Charge late fees on overdue accounts in accordance with the Service Agreement

  • Suspend services for non-payment

  • Refer overdue accounts to collection agencies

 

8. Participant Rights and Responsibilities

 

8.1 Participant Rights

 

As an NDIS participant, you have the right to:

  • Receive services that respect your dignity, privacy, and independence

  • Services free from discrimination, abuse, neglect, and exploitation

  • Access your personal information we hold

  • Provide feedback or complaints without fear of retribution

 

8.2 Participant Responsibilities

 

You are responsible for:

  • Providing accurate information about your needs and circumstances

  • Treating our staff with respect

  • Meeting the terms of your Service Agreement

  • Providing a safe working environment for our staff when services are delivered in your home

  • Giving reasonable notice for changes or cancellations

 

9. Website Use and Online Content

 

9.1 Acceptable Use

 

When using our website, you agree not to:

  • Use it for unlawful purposes

  • Transmit malicious software or content

  • Attempt to gain unauthorized access to secured areas

  • Use automated systems to access our website without permission

 

9.2 Intellectual Property

 

All content on our website, including text, graphics, logos, images, and software, is the property of Comppers Pty Ltd or our licensors and is protected by Australian and international copyright laws.

 

9.3 Permitted Use

 

You may access, view, and print content from our website for your personal, non-commercial use only. You may not modify, reproduce, distribute, or commercially exploit any content without our prior written consent.

 

10. Privacy and Personal Information

 

10.1 Data Collection and Use

 

We collect and use personal information in accordance with our Privacy Policy and relevant Australian privacy laws. By using our services, you consent to the collection and use of information as described in our separate Privacy Policy.

 

10.2 Privacy Policy

11. Limitations of Liability

 

11.1 Service Guarantees

 

Our services come with guarantees under the Australian Consumer Law. Nothing in these Terms and Conditions limits those guarantees.

 

11.2 Limitation of Liability

 

To the maximum extent permitted by law, we limit our liability for any claims arising from our services to:

  • Re-supplying the relevant services

  • Paying the cost of having the services supplied again

 

11.3 Exclusion of Liability

 

We are not liable for:

  • Indirect, special or consequential losses

  • Loss of profit, revenue, or opportunity

  • Damages arising from third party actions

  • Issues arising from circumstances beyond our reasonable control

 

12. Indemnification

 

You agree to indemnify and hold harmless Comppers Pty Ltd, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

  • Your breach of these Terms and Conditions

  • Your misuse of our website or services

  • Your violation of any rights of a third party

 

13. Dispute Resolution

 

13.1 Initial Process

 

If you have a complaint about our services:

1. Contact us at info@compperscare.com.au

2. We will acknowledge your complaint within 1 business day

3. We will investigate and respond within 21 days

 

13.2 Escalation

 

If you are not satisfied with our response, you may escalate your complaint to:

  • The NDIS Quality and Safeguards Commission (1800 035 544)

  • Australian Financial Complaints Authority (for billing disputes)

  • Office of the Australian Information Commissioner (for privacy concerns)

 

13.3 Mediation

 

Before commencing legal proceedings, both parties agree to attempt resolution through mediation by a mutually agreed mediator.

 

14. Termination

 

14.1 Termination by Participant

 

You may terminate services as specified in your Service Agreement, typically requiring 14 days written notice.

 

14.2 Termination by Provider

 

We may terminate services if:

  • You breach these Terms or your Service Agreement

  • Your NDIS funding is exhausted or withdrawn

  • We can no longer safely meet your needs

  • We provide notice as specified in your Service Agreement

 

14.3 Effect of Termination

 

Upon termination:

  • Outstanding payments become immediately due

  • We will assist with transition to another provider if requested

  • We will return any of your property or documents in our possession

 

15. Changes to Terms and Conditions

 

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. We will notify current clients of material changes via email. Your continued use of our services after changes constitutes acceptance of the modified terms.

 

16. General Provisions

 

16.1 Governing Law

 

These Terms and Conditions are governed by the laws of Victoria and the Commonwealth of Australia.

 

16.2 Severability

 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.

 

16.3 Entire Agreement

 

These Terms and Conditions, together with the Service Agreement and Privacy Policy, constitute the entire agreement between you and Comppers Pty Ltd regarding our services.

 

16.4 No Waiver

 

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
